I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.

the second charge of "false statement" to the officer is? That will look negatively on the character of the applicant.
In general traffic citations are minor misdemeanours. Not sure about fishing. But the second charge IMO is a bit serious.

1) From the day your current one expires
2) Recent court ruling is that even if it is beyond 240 days from day your current one expires, your status is valid as you are waiting for decision. You can search for this, I read it couple of months back. Or seniors may confirm this.

I'm also pleased to announce that we will be extending the validity period of the employment authorization documents that we issue to individuals who are waiting adjustment of status to lawful permit residenture or in colloquial phrase, the green card.
Currently, adjustment applications are granted employment authorization documents with only a one year maximum validity. Beginning later this month, we'll start issuing these documents with a two-year validity period for aliens who are waiting adjustment of status if their application is expected to be pending for more than a year.
This, again, is eliminating a persistent source of frustration for workers who are here, who have a pending adjustment application but have to go and renew their employment documents every single year. It's going to cut the paperwork there.

Thats not true. There are equal number of people who have EAD and still keep their H1 for some reason.

My current situation is as below
I -797 and I-94 expiry date: 10 Jun 2011
Passport expiry : 28 Oct 2011
I am filing for H1 extension through my company immigration cell. However, they informed me that my passport had to be renewed before filing the extension !! else the attached I-94 in the extended I 797 will have the expiry date only till my passport expiry :confused:
In that case, if they had to wait for my renewed passport to arrive (which can take longer) to file the extension and my I-94 might expire before that.
Can someone please provide some advice if that's the case?

Dallas-Fort Worth Immigration Lawyer Has Just Posted the Following:
Effective January 4, 2010, the U.S. Department of Health and Human Services, Center for Disease Control and Prevention (HHS/CDC) is removing HIV from the list of communicable diseases of public health significance and references to HIV from the scope of medical examinations for foreign nationals.
Until the rule goes into effect, non-citizens who are HIV-positive cannot be admitted into the U.S. unless the U.S. Department of Homeland Security (DHS) grants a waiver. Once the rule goes into effect on January 4, 2010, HIV infection will no longer be defined as a communicable disease of public health significance, immigrant visa applicants who are required to undergo a medical screening exam will no longer be tested for HIV, a waiver for entry into the U.S. will no longer be necessary, and HIV-positive visa applicants will not be found ineligible for visas under Section 212(a)(1)(A)(i) of the Immigration and Nationality Act (INA). Although foreign nationals with HIV who apply for visas will no longer be ineligible under INA Section 212(a)(1)(A)(i), they still must overcome the public charge under INA Section 212(a)(4) by demonstrating to the consular officers that they will have the means of support in the U.S. and that they will not need to seek public financial assistance.
