My MTR was received by USCIS on June 25, 2009. Today I received an auto-generated email with case status update. My MTR has been denied :-(
Any advice for the next steps is appreciated.

When we use the recent I94 (from the H1), do we need to say "were you inspected by an immigration officer?" as "yes"?
The start date for this should be the date of entry at the airport or the start date on the recent I94?
First question answer is "Yes" though you got new H1/H4 or any other visa extension papers the I-94 will be same which intially inspected by an immigration officer. That's why answer is Yes.
The start date is the time when you enter the country.

On this case, I am getting mixed anwsers
Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).
Second lawyer is saying that i should stop working on denied petition.
Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess
In fact, I am planning to get advice from murhty too...
Any thoughts on this.

Get it Notarized with photo and send the document.There are standard formats available.
If it is Power of Attorney to deal in property matters on your behalf, then the notarized copy also needs to be stamped by the Indian Consulate in your area.
So there is one more loop involved - to get it endorsed by Indian Consulate, after you have done the notarization. I believe this is something that has become applicable recently as I had to do it last month. A few years ago when I had done the first one, it was just preparing the POA document, and getting it notarized.

Hi,
I am on H1b visa and it is expiring in sep 2009 in 2 months. I need some information incase i dont get a project in mean time. I already got RFE for the extension.
Is it better to convert to H4 visa? How much it costs? and how long it takes to convert? Also do we get any kinds of problems in converting to h4 visa?
Also if we converted to h4 visa, can we easily get f1 visa if we want to study later or can we go back to h1b from h4 visa.? what all things are required.
Please let me know.

Your question is not clear. H1 is a work visa, H4 is for dependants of H1. F1 is family visa. There are no conversions. You get whichever is applicable to your situation.

I am sending my kid ( US born) with my in-laws to india. Any idea what kind of documents they need to carry ( other than passport, PIO, Birth Certificate)
any body has any expereince?
Do not forget to give grand parents a letter, duly signed by you and your wife that they are taking a minor US citizen, out of the country with parent's consent. I do not have any particular format to give you. Get it notarized, also mention the dates for which he will be outside the country. I had a tough time with Air France few years ago, I was taking my own baby and my wife was not travelling with me. Air France denied me bording because I did not have a wrttien permission from my wife !! It also differs from airline to airline.

Hi,
A consultancy firm applied for my H1b Visa this year (2009). USCIS has denied the visa showing the reasons like:
1) My manager (CEO of the company) and the person I will work under (From the client company) is different.
2) They questioned in same line about the place of my work.(office of the firm and the client).
3) They have some points regarding wages of previously employed H1bs of the firm.
There's no point however about my qualification and experience (I have a degree from IIT and work at India branch of one US multinational). The company says that they have a number of approvals this year and the particular decision depends on the officer at USCIS to a large extend. They can re-appeal addressing all the concerns mentioned by USCIS.
How much are the chances are that a denial would be converted to approval. Is the USCIS going to be very strict and judgmental about the re-appeal of the denial?. May be it is hard to tell, by I greatly appreciate any help/suggestion...

You may as well ask uscis to ask for the remainder of the H1B period provided there is an employer who is willing to process your H1B. Remember, you will have to lose your current I485 processing and start all the way from scratch though you can recapture the priority date with the new GC process.
