Hi. I am currently here in the US applying for AOS from a B2 to F1 visa. I sent my application on the 26th April with USPS Express mail request return reciept. My current 1 94 expired on April 28th. My return receipt from USPS says that my item was signed for on April 28th leaving me still in status but when I received my I 797 C it says that the receipt date is April 29th. I am very worried and I am wondering if this is something I should call their customer services department about. I do not want my application denied simply because I may seem not to be in status. Please help, I am very worried.

I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?

I am new to IV. I am just wondering whether we have ever emphasized on bifurcation of Immigration Bill or call for a interim law to facilitate legal immigrant's issues ( mainly retro victims) -
Our problems are very basic and do not have sociopolitical or economical strings attached to it (Probably works better for economy as lot of us are holding on to buy houses and other big budget stuff).
The main issue I have is
- Unable to change jobs
I can wait for GC but not being able to change jobs is hurting me most.
Employers do not find projects and do not pay on bench. Once you find a project Employer wants a big cut. All in the name of policy ;) .
Please share your thoughts.
Your issue is same as everyone's here. SKIL bill does not have anything to do with illegals, but CIR does. This organization is keeping all options open and doing everything, but for some reason, there does not seem to be an easy rsolution to our issue. The group is working hard with support of members, other similar organizations, well wishers, members, some politicians, lobbyists, media etc..

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

It is sad to see nobody coming forward for help. It is everybody's fight. When someone takes initiative we should all help. There is nothing to fear while meeting lawmakers.

Has anyone heard about the immigrant advocacy groups that are planning a protest march on Washington one day after Obama's inaguration. They plan to demand that immigration raids stop and that immigration reform be taken up during the first 100 days of Obama's administration (while recognizing that the economy comes first)

My H1B 6th Year expires August 2007 and need to apply for 7th year extension.
The below are options I read in murthy.com
1. Labor pending or approved before 365 days of H1B 6th Year expires
2. I140 Approved
Applied for PERM labor in April 2007 and still in pending status (First option ruled out)
After looking at July 2007 Visa Bulletin immediately Applied for I140 using Substitution Labor . Assuming that I can work on EAD.
And because of Revised Visa Bulletin I could not apply for I485.
Can I apply for 7th year extension based on I140 receipt (using Labor substitution)?
If no to the above question and suppose if my PERM labor is approved some time in July and if the USCIS start again the Premium for I140 Can I apply for another I140 from same employer?

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

-> i guess there is a provision to delay your FP if it arrives for any reason, any of your representative here can scan and let u see the contents , there will be a phone to call and postpone.

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? On November 13, 2006, a welcome notice was mailed for this case. If 30 days have passed and you have not received this notice. Please call the National Customer Service Center at (800) 375-5283 during business hours.
Does this constitute as a GC approval ?
I read in other threads that a "card ordered" email follows the GC approval but I haven't received the email (nor the physical card yet).
Does it normally take 1 or more weeks for the physical card to arrive after approval ?

yes there most likely will be an RFE asking for her paystubs...looking at the current trends. You might try her stamping H-4 instead. People have a higher rate of success there. For her H-4 stamping, they just might ask for your paystubs....but thats also not a complete guarantee.
