If you are still maintaining your H as long as it is above the wage on the LCA you dont have an issue. Also when your GC is appproved, you will need to make at least what was said on the labor, if not more.

Making Legals also Illegals.
For the past 10 to 13 years people are waiting on the EB category Queue, and they are all tax payers as same as US Citizen.
some of them are in H1B status, in this economy it is not necessary that they should always have a job, so if the congress
is not acting on the Immigration bill as soon as possible, they are making the Legals also Illegals pretty soon, with the
USCIS nasty memo for the Employer-Employee relationship, getting an H1 extension became another Oil spill in the Gulf Coast!
This is not a joke, and politicians care little about this, because they cannot manipulate anything here, This is the year and time
to pass immigration bill. If not then immigration issue may not see light.
What about great Indian origin media tycoons Sanjay Gupta & Fareed Sakaria, why cant they make a issue on the media about this.
All Indian origins except some bunch of people, are waste and just eat, drink & be merry caes, and they don't care for anything.

I am currently on H-1B and filed for Adjustment of Status. I filed my I-485, AP, & EAD in August 2007. I got my EAD and AP in 2007 and it expired last year as well. I did not use the AP. I am with the same employer that filed my green card application. I am continuing on H-1B and did not use EAD.
My H-1B is valid till April 2010. I have not applied for the extension of my EAD & AP. The H-1B stamp on my passport expired in August, 2007. Also, my passport is valid till October 2009. My wife is on H-4 and the visa stamp on her passport also expired in August 2007. Her H-4 is also valid till April 2010. I am planning a trip to India in the coming month.
I wanted to know the process for my travel to India at this time on H status. Should I follow the standard procedure to file for H-1B renewal stamping at Indian embassy in India. Do I need to apply for passport renewal now since I have 8 months before it expires. Is it true that now it takes 4 work days to get the visa stamp in Canada.
Your help in answering this would be really appreciated.

In a letter to Senator Grassley, the CIS defended their H-1B adjudication practices and their everything under the kitchen sink Request for Evidences.
The CIS is looking into revising the form I-129 to have Petitioner and beneficiary both attest that:
The beneficiary has been advised of the offsite placement and accepts the terms of the H-IB employment, including the job location and possible relocation;
Really? Does anyone working for the software industry not know that they have to work off site. These people are always traveling, the beneficiary KNOWS they have to work off site. Same with Oil Company Engineers. Its the nature of their work. Does CIS seriously think the beneficiary does not know?
2. Placement of the beneficiary offsite during the period of employment will be in compliance with the statutory and regulatory requirements of the H-IB nonimmigrant classification;
3. The beneficiary will be paid the prevailing rate of pay at any offsite
location; and,
This is in line with the question on the I-94 application on the plane, "Are you a terrorist." Has anyone ever answered yes to that question? Similarly, will anyone filing an H-1B petition ever say they will not comply with the law?
4. The work itinerary is attached.
The H-1B is given for 3 years. It is difficult to predict the itinerary for all those 3 years. If the work itinerary is for less than 3 years, then the employer has to file the whole H-1B again, with the high fees. And even if they have the work itinerary, the job may be canceled, etc. So what is the point of private employers filing job itineraries with the Government?
All of this simply penalizes the small employers who form the backbone of the American economy.

I currently have an L1 that is valid until Dec 2007. Meanwhile I applied for my H1 this April and I have been approved for H1 (COS) starting OCT 2007. Now my situations demands me to continue on my L1 for another 4 months. I need to send in my extension papers by November as my L1 expires DEC 2007.
PLease let me know if my H1 will be cancelled/invalid if I apply for my L1 extension.

I only know information about I-485 filing but do not know what to expect after it is filed?
Can someone tell me what to expect after things are in place? Like expecting Receipt date, fingerprinting - how many of them, what to look for and what to watch out for etc. A consolidated discussion may help many who are unaware of the system.
Who will get such information, lawyer or the applicant?

My priority date is in Oct 2005 (ROW) and yesterday was the 180th day after filing my I-485 application. I need some help in deciding if I should wait for the green card with my current employer or think of changing the job using AC21. Your suggestions will be really helpful.

check the next VB (should be out in a day or two). Based on a thread where someone found the dates from the Mumbai consulate website, EB-3 ROW might move to July 2005. if it does, it might be worthwhile hanging on a couple of more months to this job and see if you become current.
On the othe rhand if you get a really nice offer, jump. AC-21 only adds a bit of complication to your job, it does not prevent you from getting a GC.

Maybe the EXIF data will be helpful though it's not completely accurate, even though I shoot in manual it will read shutter priority. ISO usually 1600 as Josh stated above.
