YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

Every agent tells a new thing. But the fact remains that I-140 needs to be approved before 485 is adjudicated.
Also you are not current yet...you will be (if things don't change in between) on Sept 1.
I don't know what final stage mean...I have been told the same thing by my congressman rep a year and half back.....doesn't mean anything...

Assuming his I-140 gets rejected, is it going to impact his current EB3 process ? Remember, he is going to be on board with the new company only after I-140 process. By the way, new Labor will take atleast 5-6 months. Advertising, etc

He sent me scanned receipt notices via e-mail and says that it will
be fine and not ready to send the originals for some reason.

Based on your response, my understanding is that so long as I am with my current employer, travel on H1 /H4 is fine. When she gets back, I can consider using my EAD to switch jobs.
You mentioned "if you or your wife don't want to use EAD in the near future..." - to your knowledge, will there be a problem if I use my EAD during her trip to India?

Former Secretary of State and advisor to two presidents, Condoleezza Rice, addressed the San Jose Silicon Valley Chamber of Commerce earlier this week at their annual fundraiser. My I-485 was filed in month of August 2008 under EB2 .I was laid off from my I-485 sponsoring employer(A) in month of August 09 and i took another Job with employer (B) in same field in month of Sep 09. I did not file AC21 as my previous employer's(A) attorney advised not necessary to file AC21.Now I am getting new offer from another employer(C) in same position but this new employer(C) wants me to file AC21 .
What are my options now? Should i file AC21 for employer (B) first and then file AC21 for employer (C) or should i directly file AC21 for employer (C).
I will greatly appreciate your reply.

My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

Do I need to send I-9 when I switch working for my own registered LLC?

Do know that once you switch to EAD, you are no longer in H1b. I-9 is just a form and if Home-land guys ask then you need to show them and no need to send that form to USCIS.

thats what I did when I moved back to company A. My lawyer suggested as long as company A did not cancel your H1 approval you are good to go!!..Hope this helps. Good luck.

As it sound to me It means PD of primary applicant will be the PD of spouse and child.

My Company applied PERM in Sept'07 at Chicago. Till now company hasn't heard back yet and now employer is planning to file one more PERM appl. through different Lawyer. Can we file one more application without hearing/know the first case status?

You cannot file a new PERM under the same position under the same company while the other one is still pending.
The DOL states an "average" processing time of 90 days, which may be extended based on whether or not an audit or multiple audits are issued. We are however noticing the average processing time is about 4 months or so.
