Apologies if I should have looked this up somewhere within IV .
Guess it is a simple question.
What does a soft LUD mean ? I have often read that term on the forum.
I at times see that something was updated on my case..."last updated date" but then there is no status update.....for example this happened on my I131 application on Feb 4, 2009
On the I485 I think it is just that they transferred it from one office to another as the status says.

I know that PERM labor gets expired if one does not file I-140 within 180 days of labor's approval date.
I am wondering if DOL has any procedure to revive expired approved/unused PERM by filing some sort of request/appeal or by paying some sort of fees etc. or if not ,then one files a new PERM by referring the old unused approved labor for the same job and same person then DOL can give an expedited approval.
They give 180 days to file...what stops the person from filing for the I-140 within the 180 day window in the first place? Are you talking about labor substitution? If so, they got rid of it because of extensive abuses and so, don't count on it.

My 6 years H1B visa term is expiring on Apr 30th 2008. My company filed 3 years of extension on approved I140 basis, which is still pending as of Apr 30th 2008. And my I 94 is dated till Apr 30th 2008.
I filed my I 485 in June 2007 and got EAD and AP
1) What will be my status after Apr 30 2008. Will I still be on H1 status, if not what will be my status.
And what is 'H1 pending for 240 days rule'.

My fianc�e lives in Mexico and I live in the United States. We are planning on getting married this summer. As soon as I return, I'm planning on beginning the process so that my future wife could come to the United States to live with me. We plan on getting married in the Catholic Church, but we have doubts if that type of marriage is a valid one for this specific situation. Where do I mail out the packets for EAD and AP renewal (paper extensions)? Can you please tell me whether the packet should be mailed to a service center where previous EAD and AP were approved or whether it depends on the state I live in?
Please note, my original EAD, AP and I-485 were sent to NSC which were transferred to TSC internally (by USCIS) and now my I-485 is pending in TSC.
Any help is appreciated.

My company is using substituted labor for me and applying for 140 and 485. My original LC which was pending just got approved. But the physical documentation is not there.
But my company is saying that they will also apply for 140 for the original LC also. How is this possible? I'm confused. What will happen to the 485 (and the first 140) when they file second 140?

Please be careful. some days back some of my friends caught up with this substitute LC and lost money. Please be careful before investing any kind of money esp if it is for desi body shoppers. USCIS is taking strict major and many substitute LC are getting rejected. so be cautious

I am on H1, 7th year extension. My Labor just got approved. About to file 140. Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?
Let your lawyer confirm this: Get your I140 approval, if possible by using premium filing. File for a 3 year H1 extension. After extension, transfer H1 to new employer. Start GC process with new employer but maintaining your PD since your old employer aill not revoke your I140.

My employer will not withdraw my I-140. Should I still go ahead with AC21 or should I just do change of address with USCIS?

I am in the same boat. Filed July 19th . As of Last Friday not in the system.
No checks cleared. All the guys who filed with me got their receipt last week from Texas. I am the only one remaining. My I140 was approved from NSC.

Like sq footage, cabins.. etc. Do you have any link that talks about office space wrt immigration requirements,
