I have a valid H4 after receving the EAD now getting paid on 1099 (on an off), I am planning to visit India this year. My question is!
Can I come back on H4 (I have a valid stamp) or do I have to use my AP since I am using my EAD privileges for getting paid?
Will they know at the Point of Entry that I am using my EAD?

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.

She can use her AP to enter back but if she has the time and can get h1b stamped she is strongly recommended to do so. Reason behind it is if she has any over stay (out of status) in the past it won't be a problem when 485 is being processed.
In simple terms if you can get visa stamped recommended if not AP is fine. regardless she will be on adjustment of status and also H1B status (have approval notice) at the same time.

Now my project has apparently lost funding and the employer is offering me a temp job for 6 months till my 140 gets approved so I can use the approved 140 and move. But the catch is the new job requires a new H1 - different job description and pay. Will this affect my 140 filed with the old H1?
Let your lawyer confirm this: Get your I140 approval, if possible by using premium filing. File for a 3 year H1 extension. After extension, transfer H1 to new employer. Start GC process with new employer but maintaining your PD since your old employer aill not revoke your I140.

I know we are pouring our ideas in different threads including one who supports our cause like name/news of senators/rep with grades, companies (employers), univ, associations, news reporters, talk show host, media, etc.
So I thought of creating this thread just to compile list of one who support the bill (or) one who we can convince our cause to support us, etc. This will definetly help the IV core team.
I know IV core team is aware of (or working with) most of the supporters, but still each new addition counts to our success.
for e.g., I read an article few days ago "1986 bill authors make a final push" in IV news article thread (http://www.washingtonpost.com/wp-dyn/content/article/2006/09/14/AR2006091401179.html) which talks about the opinion of "1986 Immigration Reform and Control Act - IRCA, or the Simpson-Mazzoli bill" authors Romano L. Mazzoli (was a Democratic representative from Kentucky) and Alan K. Simpson (was a Republican senator from Wyoming.)
after reading this, today I thought, might be an idea to contact these former senators, who can voice our genuine legal immigration concerns. I dont think you will need them . I am also filing premium 140 and lawyer has nOT asked for all I94s ..ONly the recent one..Dont worry much if you dont have all of them

If I remember correctly, if your I-140 is "approved" and if your I-485 is pending for more than 180 days, then it "should not" be matter whether your I-140 is revoked or not.
In your case, if you get RFE (what for????) , just send the AC21 letter and you will be fine.

Hi,
I am planning to file EB2 and port my EB3-I140 PD. My current position is System Analyst with EB3 job requirement. I can get a promotion but that doesnt qualify for EB2 job requirement. So I am planning to move to a different position, Research Associate which qualifies for EB2(it requires masters degree) with the same employer. Can I file EB2 with this position and port my EB3-I140 PD? Advice pls.

Looks like the pundits are saying that the House, and possily Senate, will fall into Democrat hands beginning January.
Here is what Robert Novak says:
The conventional wisdom about the 2006 elections among both Republicans and Democrats now is that the Democrats will take control of the House and could also win the Senate. One House Republican committee chairman, who publicly exudes optimism, privately predicts -- and has predicted for six months -- a loss of 30 House seats.

If that's a wisdom, no wonder Democrats are in no mood to compromise on CIR. That also explains the chilly reception to Hutshison-Pence. When the democrats have the house they'll craft a new immigraton package and compromise with the perhaps even more democrat-leaning senate. So 2007 is going to be the year of CIR. If the republicans are smart, they're going to try to get best immigration deal possible in the lameduck session before the 110th Congress starts in January. But the democrats may block it altogether. In that case the retrictionists are going to be sorry they didn't take the best deal when it was available (which look like now).

Guys/Gals,
Do you know that if i become a named Plaintiff in 485 fiasco lawsuit and the lawsuit drags for a Year ( just vague timeline) does that imapairs my ability to file a fresh new 485 application if my PD becomes CURRENT ?
I'm also assuming that USCIS would not return my Package sent on July 2nd since i'm the middle of a live lawsuit as a plaintiff.
Thoughts ? Knowledges ?

Maybe USCIS would earn more income by telling the illegal immigrants to file EAD/I-485/Biometics every year etc.. Immigration attroneys would earn good money by replying to RFEs for 12 million immigrants. Getting this 12 million illegal immigrants legalized will surely improve the economy.

If I-140 has been approved, would it still be fine to apply for transfer from H1-B to F1 status by using form I-539 & university issued I-20 ? How long does it take to transfer status from H1B to F1 ? When can one start school �. Only after I-539 approval or after only applying ?
For pursuing an MBA, does it matter if one is on F1 or H4 (spouse is on separate H1)?
