My labor was filed with job title from the employer as IT Lead (O*Net Code - 11-3021.00, O*Net title - Computer and Information Systems Managers). I am having an opportunity to convert to full-time on EAD (I-140 approved, EAD received 18months back). The new job title is Software Engineer(possible O*Net codes - 15-1032.00/15-1021.00/15-1031.00, possible O*Net title - Computer Software Engineer/Computer Programmer). Is it possible to file AC21 in this scenario. The salary and the job descriptions for both the Labor filing and the new opportunity are similar. I am worried if the title might cause a problem. I have to make a decision very soon. Please help.
as far i have learnt from the discussions in forms "Title" should not be a problem.
But the O*Net Code should be the same.
Meaning new job should fall under the same job code.

Hello All,
I have my EAD as does my wife. We are still on valid H1s (until 2009) and I have no plans to change my employer. We also received our travel documents. The question I have, and need your input on is can my wife travel (to India) and back on her H4 (even though we've filed for adjustment of status) or does she have to use her Advance Parole to do so?

My friend with july-07 filer (I-140 approved in Jan-07) lost H1 in Mar-08 and work on EAD and his company move to new address in May-09. USCIS site visit on Aug-09 to old address for H1-b (one year ext) for his co-worker. His co-worker got letter form USCIS to submit documents in Dec-09 for existance of the Company. Company inform everyone in Nov-09 that it is going out of business and shutting down operation in Dec-09.
What are the options my friend and his co-worker with (LC/I-140 approved form another company) have??

First, your friends father needs to find an employer who is willing to sponsor him for H1B and later for GC. Usually, all legitimate employers will have a host of immigration lawyers and counselors who will take care of things from that time onwards.
That said - now may not be the best time to try and find a job in US. Finding a H1B job (i.e. one that cant be filled locally) - is even more of a challange. I wish him best of luck.
If the person has relatives in US (is your "friend" a US citizen?) - then he may be able to "quickly" (1/2 years for immidiate relative, much more for others) immigrate using the family based immigration.

H-1B Quota is still available for all employers. Employers who have not yet proceeded with new H-1B filing can go ahead now too as per their business requirements. After many years since the Cap of H-1B started, it is still available even after Sept. 30, 2009. As of this writing, there are still H1B cap numbers available, both in the advanced-degree and regular H1B quotas. This means that H1B petitions can still be filed for fiscal year 2010. These filings can continue, as long as the cap numbers are available.
We like to share that H-1B petitions can be filed throughout FY10, until the cap numbers are all depleted. Petition filed under the 2010 Cap after October 1, 2009, the start date of work requested can be immediate. Since October 1, 2009 has already passed, and the H-1B numbers are still available, filings may request an immediate validity date. Reciept notice should be recieved as soon as USCIS recieves the application. It shouldn't take much time though I kind of feel it should not take more than couple of days from USCIS part to send the reciept and then 4-5 days for postal reciept. I guess in about weekdays time after reciept at USCIS, you should recieve the notice.
This is just my understanding. Also some one said, you can start working for the new company as soon as your application is delivered to the USCIS. Get this confirmed by some one.
